Glenn Dolan of Morgan Levine Dolan Obtains a 1.2 Million Dollar Verdict in Ceiling Fall Case

Glenn Dolan of Morgan Levine Dolan obtained a 1.2 million-dollar verdict for the wife a Brooklyn building superintendent who sustained head, neck and back injuries when a portion of her bathroom ceiling collapsed.  Her husband was terminated from his job and the Housing Court had issued an Order evicting the couple from their apartment.

The defendant argued that the plaintiff’s husband, who was sued by the building owner, lied about his qualifications for the job, left the building in disrepair and should have made repairs in his own apartment. The defendant further argued that the couple remained in the apartment illegally after the husband was terminated; that the wife’s injuries were either non-existent or pre-existing, and that she was exaggerating her symptoms.

Nonetheless, the jury found the defendant landlord 80% responsible for the accident, and awarded the superintendent’s wife more than 1.2 million dollars for her injuries.
