A worker died after falling through the floor at an apartment building construction site. The worker was pronounced dead at Mount Sinai Hospital.
This construction site accident involved a worker who fell more than 15 feet to the basement below. A steel girder hit him in the head, causing his serious injuries.
Under the Labor Law in New York, the owner of the property and the general contractor are strictly liable for injuries to a construction worker who falls through the floor during a demolishion, renovation or other construction project. In this situation, the general contractor, Centex Builders, would be held legally liable for not protecting the construction worker from this type of fall.
As a result of this fall, the Deaprtment of Buildings stopped all work and the U.S. Occupational Safety and Health Administration (OSHA) opened an investigation.
